OrthoMetrics
Terms of Use

1. Purpose
OrthoMetrics is a digital platform designed to support collection, display, and export of orthopaedic patient-reported outcome measures.
2. Not Medical Advice
The platform does not provide medical advice, diagnosis, or treatment recommendations. It supports clinical monitoring but does not replace clinician judgement.
3. User Responsibilities
Users agree to:
- Use the platform only for appropriate clinical, administrative, audit, or research purposes
- Provide accurate information where possible
- Keep login credentials secure
- Not attempt to access information they are not authorised to view
4. Communications
The platform may send email or SMS messages to patients using Brevo and Twilio. Delivery of email or SMS messages cannot be guaranteed.
5. Availability
Reasonable efforts are made to keep the platform available, but uninterrupted access is not guaranteed. The platform may be updated, suspended, or modified when necessary.
6. Data Accuracy and Completeness
OrthoMetrics does not guarantee that patient-entered information is complete, accurate, or clinically validated. The platform also does not guarantee that any particular PROM will be sent, received, opened, completed, or clinically usable.
PROM collection may be incomplete because of patient non-response, withdrawal of consent, unsubscribe or STOP requests, incorrect contact details, email or SMS delivery failure, technical interruption, platform configuration, or clinic workflow decisions.
Clinicians remain responsible for interpreting information in context, monitoring whether expected PROMs have been collected, arranging any clinically necessary follow-up outside OrthoMetrics, and checking exported data before clinical, audit, or research use.
7. Limitation of Liability
To the extent permitted by law, OrthoMetrics and its operators are not liable for:
- Clinical decisions made using the platform
- Missed, delayed, or failed communications
- Incomplete or inaccurate patient-entered data
- Incomplete PROM collection or incomplete datasets
- Temporary unavailability of the platform
- Indirect or consequential loss
8. Intellectual Property
The software, design, structure, written content, and branding of OrthoMetrics are owned by or licensed to the platform operator. They may not be copied or reused without permission.
9. Privacy
Use of the platform is subject to the Privacy Policy.
10. Billing and Payments
If paid billing is enabled, clinician or clinic prepaid operation credits are handled through Stripe Checkout and the Stripe Customer Portal. Payment card details are processed by Stripe and are not stored by OrthoMetrics.
PAYG credits are prepaid credits for clinician or clinic use within OrthoMetrics. They are not a patient charge. Published PAYG prices are GST-inclusive unless clearly stated otherwise, and taxable supply records should be kept where required.
Credits do not expire. A credit is consumed when the first PROM link for a consented Private, ACC, or DHB outsourced operation is sent or queued. Public operations, declined consent, pending consent, and operations where no PROM link has been sent or queued do not consume credits.
Except where required by law or where OrthoMetrics approves a refund or manual credit adjustment, unused credits are generally non-refundable. Duplicate charges, incorrect charges, failed credit allocation, or operations entered in error may be corrected by refund, credit reversal, or manual credit adjustment.
Once a credit has been consumed, it will not normally be refunded because a patient does not respond, later withdraws consent, unsubscribes, or because PROM data is incomplete. Billing restrictions must not block existing clinical record access, consent withdrawal, privacy requests, correction requests, or clinically necessary review.
Chargebacks and payment disputes are handled through Stripe and the relevant card network. OrthoMetrics may provide billing evidence to Stripe, limited to clinician or clinic billing information and excluding patient health information.
11. Governing Law
These Terms are governed by the laws of New Zealand.
